Board of Adjustment

The Board of Adjustment meets at 7 p.m. the second Wednesday of each month in the Town Barn when it has applications to review. The Town Barn is located on the Town Hall campus at 101 E. Orange St.  Access to the site is from East Corbin Street.

The board also hears, reviews and decides the following:

• Conditional Use Permits, including modifications to these permits
• Requests for variances from specific requirements of the Unified Development Ordinance and the Flood Damage Prevention Ordinance
• Appeals from enforcement actions, orders, requirements, decisions and determinations of the Planning Director and Minimum Housing Code Inspector
• Appeals from decisions of the Technical Review Committee and Historic District Commission
• Interpretations of the Unifed Development Ordinance  

Board of Adjustment Process Summary

The board is comprised of seven members: five regular members and two alternate members.

• Three regular members and one alternate member are residents of the town and are appointed by the Town Board
• Two regular members and one alternate member are residents of the town’s extraterritorial jurisdiction and are appointed by the Orange County Board of Commissioners. The ETJ is an area outside of the town’s corporate limits where the town has zoning and subdivision regulation authority.
• One regular member also serves on the Hillsborough Planning Board and is selected by the Planning Board on an annual basis.
